Uncharted waters: navigating through extradition proceedings in the face of the coronavirus pandemic.

The article examines the potential impact of the spread of the novel coronavirus (Covid-19) on extradition and EAW proceedings, having regard in particular to the Italian legal system.
This unprecedented health crisis exposes serious deficiencies in the legislation governing mutual legal cooperation at both the Italian and international level. Albeit there typically being safeguard clauses meant to address the practical problems caused by exceptional situations, a closer look reveals that their activation may result in largely disproportionate adverse effects for requested persons, particularly in the field of pre-surrender detention.
The article suggests that a proper framing of the emergency cannot prescind from recognizing a central role to the principle of proportionality in extradition and EAW proceedings.

Il contributo analizza le potenziali ripercussioni della diffusione del nuovo coronavirus (Covid-19) sui procedimenti in materia di estradizione e mandato di arresto europeo, con particolare riguardo all’ordinamento italiano.
Sebbene vi siano solitamente clausole di salvaguardia finalizzate, almeno nelle intenzioni, a neutralizzare le problematiche connesse a situazioni emergenziali, un esame più attento rivela che la loro attivazione può, paradossalmente, generare più problemi di quelli che dovrebbe risolvere. Almeno a livello europeo, una corretta gestione dei procedimenti di consegna in una situazione di emergenza non può prescindere dal ruolo fondamentale assolto dal principio di proporzionalità.
